Tim - San Francisco has reportedly enforced this law. Other cities have, at
times made inquiries to our offices about it. Most building officials are not
aware of the law. The Seismic Safety Commission sponsored this legislation,
authored by Assemblyman Katz (Ch. 439 Statutes of 1986, H&S 39160). California
government is responsible for passing this law and not requiring regulations
to be written and updated to enforce it. The law imposes duties on local
governments and design professionals. One impediment to regulation development
has been that local government building officials don't want state amendments
to the California Building Code to be made applicable to their work. So
sometimes that's the way laws get written and become largely unenforced when
the state doesn't want to spend money.
