What you are describing is not an in plane vertical irregularity,
subject to limitations based on the length of the elements.

The condition you describe is a plan irregularity type D, out of plane
offset. Yes the 97 UBC imposes a penalty on this type of design, and yes
it really is a bad idea if it could be avoided. 

Primary problems are in the shear transfer to and from the diaphragm as
well as high local stresses within the diaphragm itself. The condition
is exacerbated by the transfer of overturning forces.
