On the subject of acceptance of non-conforming work,
there is an interesting legal principle which may
cause you to accept non-complying work.

If the cost of correcting the work is much larger than
the reduction in value to the owner the courts may
find that it would be unfair to require strict
compliance with the design documents.  In such
situations you may be limited to collecting from the
contractor an amount related to the reduced value of
the project or having him pay for the cost of a fix
that would mitigate the problem.
