Actually,  in stadiums, rules for guardrail heights are relaxed when sightlines are involved, see IBC03 1024.14.2, and 3.

        How do they get away with it?  They get away with it because everyone, from the designer(s) to the "Authority Having Jurisdiction" to issue an Occupancy Permit, didn't do their job.

My seats at staples are one level higher even than the luxury boxes. The guard rail in front of my seat is maybe 32-34" high.
